1. Acceptance of Terms

By downloading, installing, or using the FruitPack mobile application, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. These terms apply to all users of the FruitPack app within South Africa.

2. Description of Service

FruitPack is a mobile application that provides:

  • A platform to order fresh fruits and vegetables
  • Delivery services for fresh produce to your specified address
  • Order tracking and customer support
  • Account management and order history
Important: FruitPack only provides delivery of fresh produce. We do not sell or deliver processed foods, beverages, or non-food items through this platform.

3. User Accounts

Account Creation

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • One account per user is allowed
  • You must be at least 18 years old to create an account

Account Responsibilities

  • Keep your login credentials confidential
  • Notify us immediately of any unauthorized access
  • You are liable for all activities under your account
  • Update your information when necessary

4. Orders and Payments

Order Process

  • All orders must be placed through the FruitPack app
  • Orders are subject to product availability
  • We reserve the right to refuse or cancel orders
  • Order confirmation does not guarantee delivery time

Payment Terms

  • Payment is required at time of order placement
  • All payments are processed securely through Paystack
  • Accepted payment methods are displayed in the app
  • Prices include VAT where applicable

5. Delivery Services

Delivery Areas

FruitPack delivers to selected areas within South Africa. Delivery zones are subject to change and are updated regularly in the app.

Service Availability

  • Delivery times may vary based on location and demand
  • We aim for same-day delivery where possible
  • Service may be limited during public holidays
  • Weather conditions may affect delivery schedules

6. User Conduct

Users agree not to:

  • Use the app for any unlawful purpose
  • Attempt to hack, disrupt, or damage the app
  • Create fake accounts or provide false information
  • Abuse our customer service or delivery personnel
  • Use automated systems to place orders
  • Resell or redistribute products ordered through FruitPack

7. Limitation of Liability

Service Limitations

FruitPack's liability is limited to the value of the specific order in question. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, business, or revenue
  • Delays due to circumstances beyond our control
  • Food allergies or dietary restrictions not properly communicated

8. Governing Law

These terms are governed by the laws of South Africa. Any disputes arising from these terms or your use of FruitPack will be subject to the jurisdiction of South African courts. We will attempt to resolve disputes amicably before pursuing legal action.
